Risk during breastfeeding

Benefit received by a mutual society member who has to change her job position due to risk during breastfeeding, but is not able to make this change

The benefit for risk during breastfeeding is given to a mutual society member who, due to risk during breastfeeding, has to change her current job position for another one that is compatible with her condition; however, this change is not technically or objectively possible for a justified reason. This is one of the social benefits that together with the health insurance for civil servants and other benefits make up the MUFACE healthcare system.

This service does not cover situations resulting from risks or pathologies that can have a negative impact on the health of the mutual society member and/or of the breastfeeding infant, if they are not related to agents, procedures, or conditions of the job position or activity carried out.

Amount and beneficiary of the benefit

The amount of the benefit for risk during breastfeeding equates to 100% of the complementary pay earned in the third month of leave. The beneficiary is a mutual society member who has obtained the leave due to risk during the natural breastfeeding of infants under 9 months of age.

Term and place of application

Term: You can request this subsidy from MUFACE after being in this situation for 3 months.

Place of presentation:

  • Via the MUFACE electronic office 24 hours a day, 365 days a year, without having to visit a MUFACE branch.
  • In MUFACE provincial services or representative offices, or through any of the registers provided for in Article 16 of Act 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations, in addition to the Staff Body where the mutual society member works.

The Staff Body will directly notify MUFACE of the fourth month leave with the certificate of the basic and complementary remunerations earned at the start of the third month of leave and the complementary pay not paid since day 91.

Removing risk situations

The right to recognise a risk situation during natural breastfeeding will end when the most recent leave expires due to one of the following causes:

  1. Interruption of natural breastfeeding
  2. Death of the beneficiary or breastfeeding infant
  3. If the son or daughter has turned nine months of age
  4. Incorporation of the civil servant in their usual job position or another one that is compatible with their condition
  5. Any cause other than those provided for in Article 92.4 of the Administrative Mutual Society Regulations that apply to the situation

Refusal, cancellation or suspension of the right

The right to recognise a risk situation during natural breastfeeding will end when the most recent leave expires due to one of the following causes:

  1. If the beneficiary has acted fraudulently to obtain or maintain the right to the financial assistance
  2. If the beneficiary performs any employed or self-employed work or activity

The right to recognise the situation may also be suspended if the beneficiary, without a reasonable cause, rejects or abandons the indicated treatment

Regulations

This benefit is regulated by Order PRE/1744/2010, of 30 June, governing the procedure of recognising, controlling, and monitoring situations of temporary disability, risk during pregnancy, and risk during natural breastfeeding, in the Special Social Security Regime for Public Civil Servants.
